Distracted Bet Terms of Service

Effective Date: July 5, 2026

These Terms of Service ("Terms") govern your access to and use of Distracted Bet, including the website located at https://distracted.bet/, the mobile application, waitlist, public chat, wallet-connected features, SOL-based game features, smart contracts, APIs, and related services (collectively, the "Service").

The Service is operated by OpenNation Limited, a BVI business company with company number 2150524 ("Distracted Bet," "we," "us," or "our").

By accessing or using the Service, joining the waitlist, connecting a wallet, entering a game, placing a bet, sending a chat message, or otherwise interacting with the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Important Notice

Distracted Bet is a social strategy, manipulation, coordination, and wagering game involving real humans. Certain game modes may allow users to commit, stake, wager, or otherwise place SOL or other supported digital assets into game rounds.

You can lose all SOL or digital assets that you commit to a game. Do not participate with funds you cannot afford to lose.

The Service is not financial advice, investment advice, a savings product, an exchange, a broker, a casino account, or a guarantee of profit.

Wagering, betting, gaming, and digital asset laws vary by jurisdiction. It is your responsibility to ensure that your use of the Service is lawful where you are located. We may restrict, suspend, or block access in any jurisdiction at any time.

2. Eligibility

You may use the Service only if:

• You are at least 21 years old, or the legal age required to participate in wagering or similar games in your jurisdiction, whichever is higher;
• You have full legal capacity to enter into these Terms;
• You are not located in, ordinarily resident in, or accessing the Service from a Restricted Territory;
• You are not subject to sanctions, export controls, or other legal restrictions that prohibit your use of the Service;
• Your use of the Service complies with all applicable laws, rules, and regulations.

You must not use the Service if it is unlawful for you to participate in online wagering, digital asset games, games of chance, games of skill, sweepstakes, gambling, prediction games, or similar activities in your jurisdiction.

We may require age verification, identity verification, location checks, sanctions screening, wallet screening, or other compliance checks before allowing you to access some or all features.

3. Restricted Territories

The Service is not available in jurisdictions where use of the Service would be illegal, regulated without required authorization, or otherwise prohibited.

Restricted Territories include:

• The United States and its territories;
• The United Kingdom;
• The European Union and European Economic Area;
• Singapore;
• India;
• Australia;
• Canada;
• China, Hong Kong, and Macau;
• Japan;
• South Korea;
• United Arab Emirates;
• Turkey;
• Russia and Belarus;
• Any country, region, or person subject to sanctions, embargoes, or restricted-party rules, including OFAC-administered sanctions;
• Any jurisdiction where online betting, wagering, gambling, real-money games, crypto wagering, or paid prize games are prohibited or require a license, registration, approval, or authorization that we do not hold.

If you access the Service from a Restricted Territory, you do so in violation of these Terms. We may block access, void entries, cancel bets, freeze or return funds where legally permitted, and terminate your account.

4. Description of the Game

Distracted Bet is a human coordination and manipulation game. Depending on the game mode, players may use strategy, timing, social coordination, persuasion, bluffing, misdirection, signaling, or other permitted gameplay mechanics to influence outcomes.

The specific rules for each game mode, including entry requirements, bet amounts, round timing, settlement method, permitted actions, prohibited actions, fees, and prize distribution, will be displayed in the app or published through the Service ("Game Rules").

By entering a game, you agree to the applicable Game Rules. If there is a conflict between these Terms and the Game Rules, these Terms control unless the Game Rules expressly state otherwise.

We may add, remove, pause, modify, or rebalance game modes at any time.

5. Waitlist, Public Chat, and Beta Access

The Service may include a waitlist, public chat, beta program, or pre-launch features. Joining the waitlist does not guarantee access to the game, rewards, eligibility to bet, or future participation.

Public chat messages may be visible to other users. Do not post private information, wallet seed phrases, personal data, unlawful content, threats, harassment, or content that violates these Terms.

We may moderate, remove, restrict, or preserve chat content where necessary to operate the Service, enforce these Terms, investigate abuse, or comply with law.

Beta features may be experimental, incomplete, unstable, or discontinued at any time.

6. Wallets and Digital Assets

To participate in certain features, you may need to connect a compatible Solana wallet or other supported wallet.

You are solely responsible for your wallet, private keys, seed phrases, passwords, devices, and approvals. We will never ask for your seed phrase or private keys.

Wallet transactions, signatures, and smart contract interactions may be irreversible. You are responsible for reviewing all wallet prompts, permissions, transactions, fees, and smart contract calls before approving them.

SOL and other digital assets are volatile. Their value can change rapidly. You are solely responsible for any losses arising from price movements, failed transactions, network congestion, wallet errors, user error, or smart contract behavior.

7. Bets, Stakes, Escrow, and Payouts

Where the Service allows users to place bets, stakes, or entries using SOL or another supported digital asset, the amount you commit may be held by a smart contract, wallet, payment processor, escrow mechanism, or other settlement system described in the Game Rules.

By placing a bet or entering a paid game, you authorize the applicable transaction and agree that your committed amount may be lost, forfeited, paid to other players, allocated to a prize pool, used to pay fees, or otherwise distributed according to the Game Rules.

Unless expressly stated otherwise:

• Bets and entries are final once submitted and confirmed;
• Blockchain transactions cannot be reversed by us;
• Network fees are your responsibility;
• We do not guarantee that you will win, profit, recover your stake, or receive any payout;
• Payouts are subject to successful settlement, smart contract operation, compliance checks, and applicable law.

If a game round is cancelled, interrupted, compromised, or affected by technical issues, we may settle, void, refund, replay, or otherwise resolve the round in our discretion, subject to the Game Rules and applicable law.

8. Fees

The Service may charge fees, including entry fees, platform fees, settlement fees, rake, smart contract fees, withdrawal fees, or other charges disclosed in the app or Game Rules.

Fees may be deducted from stakes, prize pools, payouts, or wallet transactions. Network fees charged by the Solana network or other blockchain networks are not controlled by us.

Current fee model: Distracted Bet charges a 15% platform fee on each paid game round. Unless otherwise displayed in the applicable Game Rules, the 15% platform fee is deducted from the applicable stake, prize pool, or payout before distribution to winners. You are also responsible for Solana network fees and any wallet, RPC, payment processor, or third-party fees, which are separate from the Distracted Bet platform fee.

9. Permitted Gameplay and Prohibited Abuse

Distracted Bet may permit in-game strategy, social manipulation, coordination, bluffing, persuasion, signaling, and misdirection where those actions are part of the published Game Rules.

However, you must not engage in prohibited abuse, including:

• Using bots, scripts, automation, farms, or non-human play unless expressly allowed;
• Creating multiple accounts or wallets to gain an unfair advantage;
• Sybil attacks, vote manipulation, fake identities, or artificial coordination;
• Exploiting bugs, smart contracts, APIs, scoring systems, or settlement systems;
• Collusion outside the permitted Game Rules;
• Bribery, extortion, threats, harassment, doxxing, blackmail, or coercion;
• Market manipulation, money laundering, wash trading, fraud, or illegal financial activity;
• Interfering with other users' wallets, devices, accounts, or communications;
• Circumventing age, identity, location, wallet, or sanctions checks;
• Sharing private keys, seed phrases, or malicious wallet prompts;
• Any conduct that undermines the integrity, fairness, security, or legality of the Service.

We may determine, in our discretion, whether conduct is permitted gameplay or prohibited abuse.

10. Game Integrity and Enforcement

We may monitor gameplay, wallets, transactions, chat, device signals, and account activity to detect fraud, abuse, prohibited coordination, duplicate accounts, bots, exploit attempts, and violations of these Terms.

If we believe you violated these Terms or the Game Rules, we may:

• Warn you;
• Restrict chat or gameplay;
• Cancel entries or bets;
• Void winnings or payouts;
• Disqualify you from a round;
• Suspend or terminate access;
• Block wallets or accounts;
• Report activity to service providers, platforms, regulators, or law enforcement where appropriate.

We are not required to disclose detection methods, security rules, or internal enforcement processes.

11. No Financial, Investment, or Legal Advice

The Service is for entertainment and gameplay. Nothing in the Service is financial, investment, trading, tax, legal, or professional advice.

Any information about odds, rounds, pools, payouts, player behavior, or game outcomes is provided for gameplay purposes only and may be incomplete, delayed, inaccurate, or subject to change.

You are responsible for evaluating risks and complying with your own legal, tax, and financial obligations.

12. Responsible Play

Paid games can be risky and may be addictive. You should participate only for entertainment and only with amounts you can afford to lose.

You should not use the Service if you have a gambling problem, are self-excluded from gambling or wagering platforms, are under the influence of substances, or are otherwise unable to make informed decisions.

We may provide or require limits, cooldowns, self-exclusion tools, or other responsible play controls. We may suspend or restrict access if we believe your use of the Service creates harm or risk.

If you need help with gambling-related harm, contact a qualified professional or a responsible gambling support organization in your jurisdiction.

13. Taxes

You are solely responsible for determining and paying any taxes, duties, reporting obligations, or other governmental charges arising from your bets, winnings, rewards, payouts, losses, digital asset transactions, or use of the Service.

We do not provide tax advice. We may report information to tax authorities or withhold amounts where required by law.

14. Third-Party Services

The Service may interact with third-party wallets, app stores, websites, APIs, blockchain networks, RPC providers, payment processors, analytics providers, infrastructure providers, smart contracts, and decentralized applications.

We do not control third-party services and are not responsible for their content, security, availability, fees, actions, or terms. Your use of third-party services may be subject to separate terms and policies.

15. App Stores and Wallet Providers

If you access or download the Service through an app store, wallet, browser, or distribution platform, including the Solana dApp Store, your use may also be subject to that platform's rules, terms, and policies.

These Terms apply between you and us, not the app store, wallet provider, or platform provider, except where platform terms state otherwise.

16. User Content

You may be able to submit, send, post, or display content through the Service, including chat messages, usernames, profile information, game signals, or other communications ("User Content").

You retain ownership of your User Content. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, transmit, moderate, remove, and otherwise use your User Content to operate, secure, promote, and improve the Service.

You are responsible for your User Content and must ensure it does not violate law, infringe rights, reveal private information, contain malware, or include abusive, hateful, threatening, deceptive, or unlawful material.

17. Privacy

Your use of the Service is subject to our Privacy Policy, available at:

The Privacy Policy explains how we collect, use, disclose, and protect information, including wallet addresses, chat content, device information, location or eligibility data, and other information related to the Service.

18. Intellectual Property

The Service, including its software, design, gameplay systems, branding, logos, text, graphics, artwork, audio, code, smart contracts, documentation, and other content, is owned by us or our licensors.

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for lawful personal entertainment purposes.

You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, exploit, or create derivative works from the Service except as permitted by law or with our written permission.

19. Service Availability and Changes

We may update, modify, suspend, restrict, or discontinue the Service or any feature at any time.

We do not guarantee that the Service will be available, uninterrupted, secure, error-free, fair in every circumstance, or compatible with every wallet, device, network, or jurisdiction.

Some features depend on blockchain networks, smart contracts, wallet providers, third-party infrastructure, internet connectivity, app stores, and user behavior outside our control.

20. Security and Smart Contract Risk

Smart contracts, blockchain networks, wallets, and digital asset systems may contain bugs, vulnerabilities, exploits, or design limitations. Transactions may fail, be delayed, or be executed in unexpected ways.

You acknowledge and accept the risks of smart contract failure, exploit, oracle failure, network congestion, validator issues, wallet compromise, phishing, malicious approvals, and other technical risks.

We may pause, upgrade, migrate, or discontinue smart contract interactions where we believe doing so is necessary for security, compliance, or game integrity.

21. Suspension and Termination

You may stop using the Service at any time.

We may suspend, restrict, or terminate your access if we believe you violated these Terms, violated Game Rules, used the Service unlawfully, accessed the Service from a Restricted Territory, created risk for us or other users, engaged in prohibited abuse, or exposed us to potential liability.

Termination may result in loss of access to chat, waitlist status, games, rewards, pending entries, or other features. Where funds are involved, treatment of those funds will depend on the Game Rules, applicable law, smart contract behavior, and any compliance obligations.

22. Disclaimers

The Service is provided "as is" and "as available."

To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, fairness, uninterrupted operation, and error-free operation.

We do not guarantee winnings, payouts, odds, liquidity, player participation, uninterrupted gameplay, specific game outcomes, digital asset value, or legal availability in any jurisdiction.

23. Limitation of Liability

To the fullest extent permitted by law, OpenNation Limited, its affiliates, officers, employees, contractors, licensors, and partners will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including loss of profits, data, goodwill, SOL, digital assets, rewards, winnings, wallet access, account access, or opportunity.

Our total liability for any claim relating to the Service or these Terms will not exceed the greater of: (a) the amount of fees you paid directly to us, excluding wagers, stakes, network fees, and prize pool amounts, in the 12 months before the claim; or (b) USD $100.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

24. Indemnity

You agree to defend, indemnify, and hold harmless OpenNation Limited, its affiliates, officers, employees, contractors, licensors, and partners from any claims, damages, liabilities, losses, costs, and expenses, including reasonable legal fees, arising from:

• Your use of the Service;
• Your bets, stakes, entries, winnings, losses, wallet activity, or digital asset transactions;
• Your violation of these Terms or Game Rules;
• Your violation of law;
• Your User Content;
• Your infringement of third-party rights;
• Your fraud, abuse, manipulation, or prohibited conduct.

25. Changes to These Terms

We may update these Terms from time to time. If we make changes, we will update the Effective Date above and may provide additional notice through the Service.

Your continued use of the Service after updated Terms become effective means you accept the revised Terms. If you do not agree, stop using the Service.

26. Governing Law and Disputes

These Terms are governed by the laws of the British Virgin Islands, without regard to conflict of law principles.

Any dispute arising from or relating to these Terms or the Service will be resolved in the courts of the British Virgin Islands, unless applicable law requires otherwise.

Before bringing a formal claim, you agree to contact us at hey@distracted.bet and attempt to resolve the dispute informally.
